Service Provider: CAF Corporation Ingeniería de Costes SL (hereinafter "CAF", "we", or "us"), a limited liability company incorporated under Spanish law, registered in the Registro Mercantil de Córdoba, folio electrónico, IRUS 1000021203013, hoja CO-42956, inscripción 1.ª; CIF B-67719633; registered address: Polígono Colón, Número 3, Escalera D, Piso 3, Puerta 2, C.P. 14001, Córdoba (España). Contact: info@caf-corporation.com.
User / Customer: any natural person acting in a professional capacity or any legal entity that registers for or uses the Kpex platform (hereinafter "you" or "User").
The following definitions apply throughout these Terms:
These Terms govern all access to and use of the Kpex platform. By registering an account, clicking "I agree", or continuing to use the Services after being presented with these Terms, you confirm that you have read, understood, and agree to be bound by them.
If you are entering into this Agreement on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. In that case, "you" and "User" refer to that entity.
If you do not agree to these Terms, you must not register or use the Services.
These Terms apply to all Kpex products: Kpex 1G (Component Quick Estimator), Kpex 2G (Full Capital Cost Intelligence Platform), and Kpex Exchange (Cost Data Marketplace).
A session-based parametric estimator covering Module A (Process Plant Components), the CAF Location Factor Index (Z.4 — 196 countries), and the CAF Cost Adjustment Index (Z.5). Provides AACE Class 5 to Class 4 order-of-magnitude estimates for individual equipment items.
A full-featured SaaS platform for AACE-class capital cost estimation (Class 5 through Class 2), incorporating: persistent project and estimate management; WBS builder; Module A (Process Equipment) through Module E (Decommissioning / ABEX); Module Z Support Tools (labor rates Z.2, rental equipment Z.3, location factors Z.4, cost adjustment index Z.5, PDRI Z.6.3, ARA accuracy rating Z.6.5); historical benchmarks; PDF report generation; and team collaboration features.
A cost data marketplace connecting estimators, owner-operators, EPC firms, equipment vendors, and data partners. Enables real RFQ generation from estimates, vendor price list publication, and proprietary benchmark data contribution.
Kpex is designed in alignment with AACE International Recommended Practice 18R-97 (Cost Estimate Classification System) and AACE TCM Framework. Cost Data provided by CAF represents proprietary parametric models and historical benchmarks. AACE International has not endorsed, certified, or validated any specific output produced by Kpex.
Access to specific features is governed by the Subscription tier held by the User. CAF reserves the right to update feature availability for each tier with 30 days' notice. The current feature matrix is published at kpex.caf-corporation.com/pricing.

Paid tiers are available in monthly and annual billing cycles. Annual billing provides a discount equivalent to two months free (approximately 17%). All paid tiers include a 14-day free trial for Practitioner and Professional, as described in Section 9.
Feature descriptions are for guidance only. CAF may add, modify, or discontinue features within a tier provided the overall value delivered is not materially diminished without appropriate notice or compensation.
To access paid Services, you must create an account by providing a valid corporate email address, a password, and accurate company information. Free email domains (Gmail, Outlook, Yahoo, etc.) are not accepted for account registration, as Kpex is a professional B2B platform.
Accounts are subject to approval by CAF's administration team. CAF reserves the right to decline registration without providing a reason.
You are responsible for:
You must not share account credentials with persons outside your licensed user count. Enterprise licences define the maximum number of authorised seats; additional seats require a written agreement.
CAF will never ask for your password via email.
All prices are published in Euros (EUR) and are exclusive of applicable taxes unless expressly stated otherwise. Published prices are subject to change. Existing subscribers will be given 30 days' notice before any price increase applies to their renewal.
CAF Corporation Ingeniería de Costes SL is registered for VAT purposes in Spain. The following rules apply:
All invoices comply with the requirements of Spanish law (Reglamento de facturación, Real Decreto 1619/2012) and EU Directive 2006/112/EC.
Subscriptions are available on a monthly or annual billing cycle. The chosen cycle begins on the date of subscription activation. Annual subscriptions are charged in full on the start date and on each annual anniversary.
Payment is accepted by bank transfer (SEPA or international wire) and invoice billing. Enterprise and Data Partner customers may request custom payment terms by contacting info@caf-corporation.com.
For invoice billing, payment is due within 30 days of the invoice date. Invoices not paid within 30 days will accrue late payment interest at the rate established by Spanish law (Ley 3/2004, de 29 de diciembre, de medidas de lucha contra la morosidad en las operaciones comerciales), currently the European Central Bank reference rate plus 8 percentage points.
CAF reserves the right to suspend access to the Services if payment is more than 15 days overdue, after a written reminder.
All payment processing is handled through secure channels. CAF does not store full payment card details on its own servers.
You may cancel your Subscription at any time by contacting info@caf-corporation.com. Cancellation takes effect at the end of the current billing period (monthly or annual). You will retain full access to the Services until the expiry of the period for which you have paid.
CAF does not issue pro-rata refunds for mid-period cancellations of monthly subscriptions, except as required by applicable law or as set out in Section 9 (Right of Withdrawal).
For annual subscriptions cancelled after the withdrawal period, CAF may, at its sole discretion, offer a pro-rata credit for unused months as goodwill — this does not constitute a contractual right unless agreed in writing.
CAF may terminate your Subscription for cause (including material breach of these Terms, non-payment, or misuse) with written notice. In the event of wrongful termination by CAF, you will be entitled to a pro-rata refund of prepaid fees.
You may downgrade to a lower tier by contacting our team. Downgrades apply at the start of the next billing cycle. Content and data associated with features not available in the lower tier will be retained for 60 days, after which it may be deleted.
If you are a consumer within the meaning of Directive 2011/83/EU (Consumer Rights Directive) and Spanish law (Real Decreto Legislativo 1/2007), you have the right to withdraw from your Subscription within 14 calendar days of the date of subscription activation, without giving any reason.
Waiver of withdrawal right for digital content: By accessing and using the Kpex platform during the 14-day withdrawal period, you expressly consent to the supply of digital services beginning before the end of the withdrawal period, and you acknowledge that you thereby lose your right of withdrawal once performance has begun, in accordance with Article 16(m) of Directive 2011/83/EU and Article 103(l) of Real Decreto Legislativo 1/2007.
To exercise the withdrawal right before using the Service, contact us at: info@caf-corporation.com with subject "Right of Withdrawal — Kpex Subscription". We will confirm receipt and process any applicable refund within 14 days using the same payment method used for the original transaction.
The 14-day free trial available for Practitioner and Professional tiers is separate from the statutory right of withdrawal. The trial allows evaluation of the Service without charge; no withdrawal right applies to a free trial.
The Kpex platform, including all software, Cost Data, parametric models, visual content, documentation, trademarks, and the Kpex brand, is owned by or licensed to CAF Corporation Ingeniería de Costes SL and is protected by Spanish and international intellectual property law.
Your Subscription grants you a non-exclusive, non-transferable, revocable licence to access and use the Services strictly for your own internal business purposes, subject to your active Subscription and these Terms. No other rights are granted.
You may not: copy, reproduce, modify, distribute, sell, sublicense, reverse-engineer, or create derivative works from any part of the Kpex platform or Cost Data without CAF's express prior written consent.
Export of cost data in standard report formats (PDF, Excel) is permitted within the limits of your Subscription tier and for your own internal professional use.
You retain all ownership rights to User Content (projects, estimates, WBS structures) that you create within Kpex. You grant CAF a limited, non-exclusive licence to store, process, and display your User Content solely for the purpose of providing the Services to you.
CAF will not use your User Content to train AI models or to derive competitive intelligence without your explicit written consent.
If you provide feedback, suggestions, or ideas to CAF regarding the Services, you grant CAF a perpetual, royalty-free licence to use such feedback without restriction and without obligation to compensate you.
CAF processes personal data in accordance with Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018 (LOPDGDD), and CAF's Privacy Policy, which is incorporated into these Terms by reference.
By using Kpex, you acknowledge the collection and processing of personal data as described in the Privacy Policy. For enterprise or multi-user accounts, the account administrator is responsible for informing team members about data processing practices.
Where CAF processes personal data on your behalf (e.g., data you upload containing employee information), CAF acts as a data processor and the terms set out in the Data Processing Agreement section of the Privacy Policy apply.
This section applies exclusively to Users enrolled in the Kpex Exchange Data Partner programme.
Data Partners contribute executed project cost data to the CAF benchmarking network. Contributed data must: be anonymised (no client names, project names, or identifying locations); be based on actual executed costs; and be contributed in the format specified by CAF.
You warrant that you have the right to contribute the data and that doing so does not breach any confidentiality obligation, intellectual property right, or applicable law.
By contributing data, you grant CAF a perpetual, irrevocable, worldwide, royalty-free licence to use, aggregate, anonymise, transform, and commercialise the contributed data as part of the Kpex Cost Data ecosystem. This licence survives termination of your Data Partner agreement.
Revenue share terms, rates, and payment schedules are defined in the separate Data Partner Agreement signed between you and CAF. In the absence of a signed Data Partner Agreement, no revenue share obligation exists.
Data Partner status includes full Kpex 2G Enterprise-equivalent access at no annual subscription fee, conditional on active data contribution. CAF reserves the right to revert a Data Partner to a paid tier if data contribution requirements are not met, with 60 days' notice.
This section applies to Vendors listing products through Kpex Exchange.
By listing products or responding to RFQs through Kpex Exchange, Vendors agree that:
Vendor Portal pricing is governed by the applicable Vendor membership tier (Vendor Basic or Vendor Pro) as published at the time of subscription.
You agree not to use the Services to:
Violation of this section may result in immediate suspension or termination of your account without refund.
All Cost Data, parametric models, benchmarks, location factors, and cost indices provided through Kpex are:
CAF does not warrant that the Cost Data is complete, error-free, or suitable for any specific project. Users are solely responsible for the professional use of any output generated by Kpex.
CAF aims to provide a service availability of 99% measured on a monthly basis, excluding scheduled maintenance windows. Scheduled maintenance will be notified via the platform dashboard and/or email at least 48 hours in advance, except in the case of emergency maintenance.
CAF is not liable for unavailability caused by factors outside its reasonable control, including internet infrastructure failures, third-party service outages, force majeure events, or User-side connectivity issues.
CAF reserves the right to suspend access temporarily for system updates, security patches, or infrastructure upgrades. Such interruptions do not constitute a breach of contract and do not entitle the User to a refund unless the cumulative downtime exceeds 72 hours in any calendar month.
To the maximum extent permitted by applicable law:
Nothing in these Terms limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) any other matter that cannot be excluded or limited by Spanish law.
Where you are a consumer under EU law, applicable mandatory consumer protection rules shall prevail over any conflicting provision of this section.
You agree to defend, indemnify, and hold harmless CAF and its directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Services in violation of these Terms; (b) your User Content; (c) your violation of any applicable law or third-party right; or (d) your professional use of Cost Data outputs.
CAF may suspend your account with immediate effect and without liability if: (a) you materially breach these Terms and fail to remedy the breach within 10 days of notice; (b) there is a credible security threat to the platform from your account; (c) required by law or regulatory authority; or (d) payment is overdue by more than 15 days.
You may terminate your account at any time by contacting info@caf-corporation.com. Termination does not entitle you to a refund of prepaid fees except as set out in Section 8 or Section 9.
Upon termination, your access to the Services ceases. Your User Content will be available for export in standard formats (PDF, Excel) for a period of 60 days following the termination date, after which CAF may permanently delete it. CAF will retain backup copies for a further period as required by applicable law.
The following sections survive termination: 10 (Intellectual Property), 15 (Disclaimer on Cost Data), 17 (Limitation of Liability), 18 (Indemnification), 21 (Governing Law), and any payment obligations incurred prior to termination.
CAF may modify these Terms at any time. Material changes will be communicated by email to the registered account address and/or by prominent notice within the platform at least 30 days before the changes take effect.
Your continued use of the Services after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you may cancel your Subscription before the effective date pursuant to Section 8.
For free (Explorer) accounts, continued use of the platform following notice of updated Terms constitutes acceptance.
These Terms are governed by the laws of Spain, without regard to its conflict of law principles.
For B2B disputes: The parties submit to the exclusive jurisdiction of the courts of Córdoba, Spain.
For consumer disputes: If you are a consumer, you may bring proceedings in the courts of the EU Member State in which you reside, as required by Regulation (EU) 1215/2012 (Brussels I Recast).
Where mandatory EU consumer protection laws provide you with greater rights than those set out in these Terms, those mandatory rights prevail.
As required by Regulation (EU) No 524/2013 on Online Dispute Resolution, the European Commission provides an ODR platform for resolving disputes between consumers and businesses that is accessible at:

These Terms are provided in English. In the event of any conflict between a translation and the English version, the English version prevails.
